By accessing or using Brandmanna ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. These terms apply to all visitors, users, and others who access or use the Service.

Service Description

Brandmanna is an AI-powered content generation platform that helps businesses create consistent, brand-aligned content across multiple platforms. The Service includes content generation, brand voice analysis, content scheduling, social media publishing, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account and keep your account information up to date. You must notify us immediately of any unauthorized use of your account or any other breach of security.

Content Ownership

You retain full ownership of all content you create, upload, or generate through the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you. We may use anonymized and aggregated data derived from usage of the Service to improve our AI models and overall service quality. This anonymized data will not be attributable to you or your brand.

AI-Generated Content

Content generated by our AI tools is provided "as-is." While we strive for high quality and accuracy, AI-generated content may contain errors, inaccuracies, or inconsistencies. You are solely responsible for reviewing, editing, and approving all content before publishing or using it in any capacity. We do not guarantee that AI-generated content will be free from errors, suitable for any particular purpose, or compliant with any specific regulations.

Subscription & Billing

Paid features of the Service are billed on a subscription basis through Stripe. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. Refunds are handled on a case-by-case basis at our discretion.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Generate content that is harmful, abusive, harassing, or discriminatory
• Create misleading, deceptive, or fraudulent content
• Infringe upon the intellectual property rights of others
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its related systems

Intellectual Property

The Service and its original content, features, and functionality are owned by Brandmanna and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, Brandmanna shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. In no event shall our aggregate liability exceed the amount you paid us in the twelve months preceding the claim.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us or through your account settings.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved through binding arbitration or in the courts of competent jurisdiction.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
